These Terms and Conditions (the “Terms”) govern your access to and use of puraluxe.com and any related websites, content, products, professional programs, certification materials, and services provided by Pura Luxe (“Pura Luxe,” “we,” “us,” or “our”). By accessing the Site, creating an account, enrolling in a program, or purchasing a product, you agree to these Terms and to the policies referenced here. If you do not agree, please do not use the Site.

1. Eligibility and lawful use
You must be at least the age of majority in your jurisdiction, or use the Site with the permission and supervision of a parent or legal guardian. You may use the Site only for lawful purposes and in accordance with these Terms.

2. Accounts and professional information
You are responsible for providing accurate, current, and complete information and for safeguarding your account credentials. Notify us promptly if you suspect unauthorized account activity.

Certain products, pricing, education, certification, or stylist-locator features may be limited to licensed professionals. We may request information reasonably necessary to verify professional status, training, or eligibility. Certification is based on completion of the applicable Pura Luxe education and assessment requirements. Pura Luxe may suspend or revoke professional access or certification obtained through false, incomplete, or misleading information.

3. Products and professional use
Product descriptions, instructions, education, and results are provided for general informational purposes. Professional products must be used only by appropriately trained and licensed professionals, in accordance with product labels, instructions, safety information, and applicable law. Individual results may vary. Nothing on the Site is medical advice, and our products are not intended to diagnose, treat, cure, or prevent disease.

4. Orders, pricing, and availability
We reserve the right to accept, refuse, limit, or cancel an order, including for product availability, suspected fraud, eligibility restrictions, pricing or description errors, or violation of these Terms. An order confirmation acknowledges receipt of your order but does not guarantee acceptance. Prices, promotions, product availability, and shipping charges may change without notice. You are responsible for applicable taxes, duties, and fees shown at checkout or imposed by the destination jurisdiction.

5. Payment
Payments are processed through third-party payment providers. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges. We do not directly store complete payment-card information.

6. Shipping and delivery
Shipping and delivery dates are estimates and are not guaranteed. Risk of loss and title pass as provided by applicable law and the selected carrier’s terms. You are responsible for providing a complete and accurate delivery address. We are not responsible for delays caused by carriers, customs, weather, supply interruptions, or events outside our reasonable control.

7. Returns, refunds, and damaged orders
Unless a different policy is stated at checkout or on the applicable product page, sales of Pura Luxe products, professional products, certification kits, downloadable materials, and equipment are final. This final-sale policy does not limit rights that cannot legally be waived. If your order arrives damaged, defective, or materially different from what you ordered, contact us promptly at contact@puraluxe.com with your order number and supporting photos so we can review the matter.

8. Site accuracy and changes
We strive to present accurate information, but the Site may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, pricing, promotions, availability, shipping, or other matters. We may correct or update information and cancel affected orders, subject to applicable law. We may modify, suspend, or discontinue any part of the Site or our offerings at any time.

9. Intellectual property
The Site and its content—including trademarks, logos, product names, text, graphics, photographs, videos, educational materials, downloads, designs, and software—are owned by or licensed to Pura Luxe and protected by intellectual-property laws. Except for personal, noncommercial use of the Site, you may not reproduce, modify, distribute, sell, publish, display, create derivative works from, or otherwise exploit Site content without prior written permission.

10. User submissions
If you submit reviews, photos, comments, testimonials, salon information, or other content, you retain any ownership rights you have and grant Pura Luxe a nonexclusive, worldwide, royalty-free, sublicensable license to host, reproduce, adapt, publish, display, and distribute that content for operating, improving, and promoting our business, subject to applicable law. You represent that you have the necessary rights and permissions and that your submission is accurate, lawful, and does not infringe another person’s rights. We may remove submissions at our discretion.

11. Prohibited conduct
You may not misuse the Site; interfere with its operation or security; introduce malicious code; attempt unauthorized access; scrape or harvest information except as permitted by law; impersonate another person; submit unlawful, deceptive, defamatory, abusive, obscene, or infringing content; resell restricted professional materials without authorization; or use the Site in violation of applicable law.

12. Third-party services and links
The Site may include links to or integrations with third-party services. We do not control and are not responsible for third-party content, availability, security, or practices. Your use of third-party services is governed by their own terms and privacy policies.

13. Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms.

14. Disclaimer of warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or that all information will always be complete or current. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

15. Limitation of liability
To the fullest extent permitted by law, Pura Luxe and its officers, directors, employees, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from the Site or these Terms. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pura Luxe and its officers, directors, employees, affiliates, agents, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, your breach of these Terms, or your infringement of another person’s rights. This section does not apply to claims arising solely from a defect in a Pura Luxe product.

17. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Except where prohibited by law, disputes not resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Pura Luxe may elect to require an eligible dispute to be resolved through confidential, final, and binding individual arbitration administered by JAMS under its applicable rules. Any arbitration will apply California substantive law and will proceed on an individual basis, not as a class or representative action, except where such a restriction is unenforceable. Either party may bring an eligible matter in small-claims court.

18. Changes to these Terms
We may update these Terms from time to time. The revised version will be posted with a new effective date. Your continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by law.

19. Severability and waiver
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
